Terms of Service

• "Service" refers to the PreConsent website, platform, API, and all associated tools and features.
• "User", "you", "your" refers to any individual or entity that accesses or uses the Service.
• "Scan" refers to an automated analysis of a website to detect pre-consent data flows, cookies, trackers, and fingerprinting techniques.
• "Plan" refers to a subscription tier (Free, Starter, Pro, or Agency) that determines your access level and usage limits.

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior.

You agree to use the Service only for lawful purposes. You may not:

• Scan websites without a legitimate reason (e.g., auditing your own site, consulting for a client, security research)
• Use scan results to harass, blackmail, or extort website owners
• Attempt to disrupt, overload, or compromise the Service infrastructure
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated tools to scrape, harvest, or extract data from the Service beyond the provided API
• Resell or redistribute the Service without authorization
• Circumvent usage limits, quota enforcement, or billing controls

The Service offers both free and paid subscription plans. For paid plans:

• Billing: Subscriptions are billed monthly through our payment provider, Lemon Squeezy. By subscribing, you authorize recurring charges.
• Plan limits: Each plan has defined monthly scan and compare limits. Usage resets at the beginning of each billing period.
• Feature access: Features are gated by plan tier. Upgrading grants immediate access; downgrading restricts access at the end of the current billing period.
• Cancellation: You may cancel your subscription at any time. Access to paid features continues until the end of the current billing period.
• Refunds: Refunds are handled on a case-by-case basis. Contact us within 7 days of a charge for refund requests.

PreConsent provides automated scans that detect third-party requests, cookies, and fingerprinting techniques fired before user consent is obtained. You acknowledge that:

• Scan results are provided "as-is" for informational purposes and do not constitute legal advice
• Results may not capture all tracking activity due to dynamic loading, A/B testing, geolocation variations, or other technical factors
• Jurisdiction-specific labels and legal references are informational guides, not definitive legal interpretations
• You should consult qualified legal counsel before making compliance decisions based on scan results

The Evidence API provides programmatic read-only access to scan data. API usage is subject to:

• Plan requirements: Available only on Pro and Agency plans
• Rate limits: Fair-use rate limits apply per plan tier
• Key security: You are responsible for keeping your API keys secure. Compromised keys should be revoked immediately.
• Scope: The API is read-only by design. It does not expose scan triggering or write operations.

The Service allows users to claim ownership of domains. Domain owners can control whether public scan results are visible for their domains. You agree that:

• You will only claim ownership of domains you legitimately control
• Ownership verification must be completed through the provided mechanism
• False ownership claims may result in account suspension

The Service, including its design, code, features, and documentation, is owned by PreConsent and protected by intellectual property laws. You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to process your data as necessary to provide the Service.

Scan results generated by the Service are licensed to you for your internal use. You may share scan results with clients or stakeholders as part of your professional activities.

To the maximum extent permitted by applicable law:

• The Service is provided "as-is" and "as-available" without warranties of any kind, whether express or implied
• We do not warrant that the Service will be uninterrupted, error-free, or completely accurate
• In no event shall PreConsent be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim

You agree to indemnify and hold harmless PreConsent, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content or data you submit to the Service

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account data after a reasonable retention period
• Provisions that by their nature should survive termination will survive (including limitation of liability, indemnification, and dispute resolution)

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PreConsent is established, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will make reasonable efforts to notify you of material changes via email or in-app notification.
